Terms of Service

1. Acceptance of Terms

By purchasing and downloading the LandingEase source code and associated materials (the "Product"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you should not purchase or use the Product.

2. License Grant

LandingEase grants you a non-exclusive, non-transferable, limited license to use the Product for a single deployed website or application. Your license includes:

• The right to install and run the Product on servers you control
• The right to modify the source code for your own use
• The right to deploy one instance of the Product as your personal brand website
• The right to use the Product for commercial purposes (e.g., operating your coaching business, selling digital products)
• Lifetime access to the version purchased, including any minor updates

3. Restrictions and Prohibited Uses

You may NOT:

• Resell or redistribute: You cannot resell, redistribute, or share the Product with others, either in original or modified form.
• Multi-site deployment: You cannot deploy the Product to multiple websites, applications, or domains without purchasing additional licenses.
• White-label or agency use: You cannot offer LandingEase as a service to clients or repackage it as your own product.
• Public repositories: You cannot publish the source code to public repositories (GitHub, GitLab, etc.) without permission.
• Remove attribution: You cannot remove or alter copyright notices or attribution to LandingEase.
• Reverse engineering: You cannot attempt to reverse engineer or decompile the Product for the purpose of creating competing products.

4. Refund Policy

LandingEase is a digital product. All sales are final, and no refunds are issued for:

• Source code downloads
• Setup assistance or consulting services
• Change of mind after purchase

If you experience a technical issue preventing you from accessing your purchase within 24 hours of payment, please contact support@landingease.com, and we will work to resolve the issue. If the issue cannot be resolved, a full refund may be issued at our discretion.

5. Limitation of Liability

To the fullest extent permitted by law, LandingEase shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or other intangible losses, even if advised of the possibility of such damages.

The total liability of LandingEase shall not exceed the amount you paid for the Product. Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, so these limitations may not apply to you.

6. Intellectual Property Rights

LandingEase retains all intellectual property rights to the Product, including but not limited to source code, design, architecture, and functionality. Your purchase grants you a license to use the Product, not ownership of it.

You retain ownership of any content you create or customize within the Product (e.g., your website copy, images, blog posts). However, you grant LandingEase a license to use anonymized usage data for improving our services.

7. Payment Terms

All payments are processed through Stripe and are final. You agree to:

• Provide accurate and complete payment information
• Pay any applicable taxes in your jurisdiction
• Comply with all applicable laws regarding online commerce

LandingEase is not responsible for any fees imposed by your bank or payment processor. If a payment fails, your order will not be processed.

8. Termination

Your license to use the Product is granted perpetually and does not expire. However, LandingEase reserves the right to:

• Revoke your license if you violate these Terms
• Revoke your license if you engage in illegal activities using the Product
• Revoke your license if you resell, redistribute, or misuse the Product

Upon termination, you must cease all use of the Product and delete all copies in your possession.

9. Support and Maintenance

Your purchase includes:

• Comprehensive setup guide and deployment documentation
• Access to the source code and all assets
• Optional 20-minute setup call to get you started
• Email support for technical issues (response within 48 hours)

LandingEase does not provide ongoing maintenance or custom development services beyond these basics. You are responsible for managing your own server and deployment.

10. Disclaimer of Warranties

The Product is provided "as is" without warranty of any kind, express or implied. LandingEase disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Product will be error-free or uninterrupted. Use of the Product is at your own risk.

11. Indemnification

You agree to indemnify and hold harmless LandingEase, its officers, and employees from any claims, damages, or losses arising from:

• Your use or misuse of the Product
• Violation of these Terms
• Violation of any applicable law or regulation
• Infringement of any third-party rights by your content or modifications

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of laws provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.
